Pesticides



The importation, storage, sale and use of pesticides are controlled by -
"The Control of Poisonous Substances Regulations, 1995", and as inferred by the title of the regulations, cover chemicals perhaps not regarded as a pesticide.


The regulations apply to poisonous substances, that is to say, any pesticide and any substance, preparation or organism prepared or used for any of the following processes: -

a. Protecting plants or wood or other plant products from harmful organisms

b. Regulating the growth of plants

c. Giving protection against harmful creatures

d. Rendering such creatures harmless

e. Controlling organisms with harmful or unwanted effects on water systems, buildings or other structures, or on manufactured products

f. Protecting animals against ectoparasites, e.g. ticks, lice, mites & insects

This definition would also include substances such as antifouling paints used to prevent the fouling of a vessels hull below the water-line, however only products which have full approval in the United Kingdom or licensed approval in Guernsey may be used locally.

Perhaps the most important issue raised by the regulations is the notion that all those who have contact with poisonous substances must be competent to deal with them in a safe manner. Thus the introduction of competency training was integrated into the regulations, a "grandfather" clause allowing existing users to continue without certification until April 1999 was included.

All persons now involved must hold a relevant certificate of competency. Client Services are able to offer NPTC Training.

Professional pesticides therefore can only be purchased by certificated persons with certain controlled substances requiring a Licence.
